No-Fault Remake Policy

Peterson Dental Laboratory (“PDL”) is pleased to offer a No‑Fault Remake Policy to help resolve qualifying remake or adjustment requests efficiently and professionally, without the need to determine responsibility or fault.

Limited Warranty

Peterson Dental Laboratory (“PDL” or “the Lab”) warrants that all dental restorations are fabricated according to the prescribing clinician’s specifications and approvals, with the belief that they will be useful. PDL MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, EXCEPT AS OTHERWISE STATED IN APPLIACABLE PDL POLICIES. If a restoration manufactured by PDL is delivered, placed, and subsequently fails, PDL will, subject to the return of the original restoration, as its discretion repair or replace the restoration for the cost of materials and workmanship, or refund the original laboratory fee paid. This warranty applies only when restorations are fabricated in accordance with PDL clinical guidelines, design recommendations, and approved workflows.

If PDL identifies a concern related to case design, materials, occlusion, clearance, angulation, or supporting structures, and the prescribing clinician elects to proceed without correction, warranty coverage may be limited or excluded for failures related to the identified concerns. Documented case approval, including approval to proceed following identified concerns, constitutes acceptance of the associated limitations and risks.

Account Status & Warranty Service Conditions
Warranty, remake, and credit services are provided subject to the prescribing clinician’s account being in good standing. Outstanding balances must be resolved prior to the fabrication or release of remake restorations. Credits, if issued, will be applied to the customer account and are not redeemable for cash. PDL reserves the right to suspend remake production or delivery until account obligations are satisfied. This provision does not extend or expand warranty coverage beyond the applicable warranty period.

Return, Remake, and Credit Request

To ensure prompt and accurate handling of returns, remakes, or credit requests, please follow the guidelines below. Complete information allows our team to evaluate and process your request as efficiently as possible.

Required Materials

When returning a case, please include:

  • The original restoration(s)
  • The original model(s) and bite, if applicable
  • A copy of the original prescription (RX)
  • A brief explanation of the reason for the return, remake, or credit request

Documentation

All supporting materials and documentation must accompany the returned items to avoid processing delays.

Return Timeframe

  • Requests must be submitted within applicable warranty or remake time periods.
  • Provisional Restoration Exceptions are as follows:
    • Restorations included: Next Day Flippers, Next Day Screw-retained Provisionals, Next Day AOX Provisionals
    • Immediate load provisionals do not need to be returned with submission of a remake request.
    • The original restoration must be returned to the dental lab within 10 business days after the invoice date of the remake.
    • All original Required Materials and remake Required Materials must be returned for evaluation.
    • The remake will be reviewed to determine if craftmanship and materials are the cause to the remake.

Shipping

Please package all items securely to prevent damage during transit. Ship returns according to Peterson Dental Lab’s current return instructions.

Fixed Restorations (Crown & Bridges)

  • Zirconia, Porcelain to metal (PFM), all-ceramic; and full metal crown and bridges, up to 2 years from date of invoice.
  • Provisionals, up to 3 months from date of invoice.
  • Transitional crowns and bridges, up to 2 years from date of invoice.

Removable Prosthetics

  • Dentures (excluding immediate and provisional dentures), up to 1 year from date of invoice. Excludes overdentures without metal frameworks.
  • Thermoformed splints, flippers, and flexible partials and provisional partials, up to 6 months from date of invoice, if failure is due to defects in materials or workmanship. Soft guards excluded and up to 30 days.
  • Immediate and provisional dentures, partials, retainers, prosthetic stents, surgical guides, and radiographic guides and all other dental devices manufactured by lab up to 30 days, if failure is due to defect of materials or workmanship.

Fixed Implants

  • Custom Implant Abutments manufactured by the lab, up to 5 years, for the original patient receiving the restoration and from the date of invoice. Excludes cases with implant angulations greater than 25 degrees.
  • Titanium base (Ti-base) crowns and bridges manufactured by the lab, up to 2 years, for the original patient receiving the restoration and from the date of invoice.
  • Provisional implants prosthesis manufactured by the lab, up to 60 days.

AOX

  • Zirconia restorations director to MUA or utilizing tibases, excluding cantilevers over 12mm and interimplant spans over 18mm and angulations over 25 degrees, up to 5 years.
  • Zirconia restorations with implant bars, excluding cantilevers over 15mm and interimplant spans over 20mm and angulations over, up to 5 years.
  • Provisional restorations, up to 4 months.
  • Transitional restorations, up to 6 months.

Liability & Legal Limitation

This warranty is provided exclusively for the benefit of the prescribing clinician, is non‑transferable, and does not extend to patients or any third parties. The prescribing clinician agrees to be responsible for all other costs of adjustment, repair, or replacement of a restoration unless such costs are expressly covered under this warranty. Peterson Dental Laboratory (“PDL”) expressly disclaims all implied warranties, including but not limited to any implied warranty of merchantability or fitness for a particular purpose, except as otherwise expressly stated in applicable PDL warranty policies. To the maximum extent permitted by law, PDL shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from or related to the use of a dental restoration, regardless of the legal theory asserted, including warranty, contract, negligence, or strict liability. PDL is not responsible for any clinical or chairside time, loss of chair time, or associated practice costs. If any disclaimer contained herein is deemed unenforceable under applicable law, the duration of any implied warranty shall be limited to ninety (90) days from the date of delivery of the restoration. In the event of a dispute, and absent amicable resolution, the parties agree to waive participation in any class action and consent to mandatory individual arbitration in accordance with applicable law. PDL does not guarantee the performance of independent carriers used for the transport or delivery of dental devices. If any provision of this section is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Customers must adhere to the steps outlined below for a successful return. NOTWITHSTANDING ANY OTHER PROVISION OF THIS WARRANTY OR ANY OTHER PDL POLICY, YOU UNDERSTAND AND AGREE THAT PETERSON DENTAL LABORATORY (“PDL”) SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM OR IN ANY WAY CONNECTED TO YOUR RELATIONSHIP WITH PDL OR THE USE OF ANY DENTAL DEVICE OR RESTORATION, WHETHER SUCH DAMAGES ARE FORESEEABLE OR NOT AND HOWEVER CAUSED, TO THE MAXIMUM EXTENT PERMITTED BY LAW.SOME JURISDICTIONS DO NOT ALLOW OR IMPOSE LIMITATIONS ON THE EXCLUSION OR LIMITATION OF CERTAIN TYPES OF DAMAGES; IN SUCH JURISDICTIONS, THE FOREGOING LIMITATIONS SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, YOU EXPRESSLY AGREE THAT PDL’S TOTAL AND AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS, LOSSES, DAMAGES, OR INJURIES ARISING OUT OF OR RELATING TO PDL’S ACTS OR OMISSIONS, REGARDLESS OF THE FORM OR THEORY OF THE CLAIM, WHETHER IN WARRANTY, CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO PDL FOR THE SPECIFIC DEVICE(S) OR RESTORATION(S) GIVING RISE TO THE CLAIM.
